If one parent contests another parent's move away petition and is successful, does that mean that custody is given automatically to the parent who contested, even if the parent who wanted to move away stayed put?
We are in AR currently.

Hmm ... my stbx says he will contest my wish to move away with the children that I plan to present as a part of the divorce settlement. However, he does not want custody, nor could he really take it as he travels an average of 7-10 days/month for his job. Our court date isn't until April so I have time to consult my lawyer over the nuances of these types of cases, but in the meanwhile I am very curious what other's experiences have been.

Sometimes the courts will allow you to move with the children BUT you will have to pay for ALL transportation costs for every visitation.

Normally, it if is hours away, the visitation will change to part of all major holidays will be with the NCP and 6-8 weeks during the summer.
