I have a question, my brother has left for Iraq recently, he is also been going thru a divorce this last year and half. The last time he was in Iraq, his wife decided to find other and when he returned from Iraq, he had a funeral later that day to present the flag to one of his fellow solders whom died. Five days later his wife tells him she wants him out and wants a divorce. They have 3 kids together. It has taken him awhile to totally understand what was happening, but he has started to pick up his pieces. They are in the process and he again has left for Iraq. Before he left he tried to get his family to take his weekends or atleast seem them once a month. Clac (we call her) said there is no way his family will have anything to do with the kids. But he was fustrated because she drinks and leaves the kids with a teen babysitter more than she is home. He would rather his family care for them knowing that there is love and not just money to be made. His parents are very interested in going for grandparents rights. We live in Illinois. They can file for "special circumstances" but is it necessary that they have a attorney, or can they do it thru the court themselves? Or is it better for attorney? She has with held these children from his family the first time he was in Iraq fighting for our country. And these children need to have the bond with the fathers side, where there is love for them. Also the mother has no real family. Her mother has pasted away and she does not get along with her father. Her bother and her are good drinking buddies thought. But not real kid friendly. So hopefully, we can get some help so these beautiful children can recieve the love they are seeking. thanks

Grandparent Issues: Illinois
Grandparent Rights to Visitation: Visitation may be granted if either the parents are not cohabiting on a permanent or indefinite basis, one of the parents has been absent from the martial residence for over one month without the other spouse knowing his /her whereabouts, one of the parents is deceased, one of the parents joins in the petition with the grandparents or great-grandparents, or if a sibling is in state custody. Illinois Compiled Statutes, Title 750, Illinois Compiled Statutes, Section 5/607 (750 I.C.S. §5/607).
When Adoption Occurs: Visitation rights terminate unless the adoption is by a stepparent.
Child Custody Statutes: Best interest of child considering: (1) wishes of parents and child; (2) interaction and interrelationship between the child and parents, siblings and other significant persons; (3) adjustment to home, school and community; (4) mental and physical health of parties and child; (5) any physical threat to child; (6) each party's willingness to encourage and facilitate continued contact between the other parent and the child. 750 I.C.S. §5/602 et seq.

For those of you's interested, Illinois has changed there grandparents rights laws. If your child is in the military,and you are being held from seeing your grandchildren, you may go to court and file under "Special Circumstances". One parent must agree with visitation, and then you may file for "Special Circumstances". So anyone in the situation like above, there is hope and a chance, that the other parent can not alienate the other side of the family and punish the children for there mistakes or make their childrens life, miserable as their own. Everyone pray for our soldiers overseas and the children of the soldiers which are very precious and are missing their loving parent.
