My stbx and I are currently living together. We have three children who I plan on gaining full custody of. I spoke with a lawyer who I plan to use, but she is on vacation until the end of the month. My question is...can stbx hire a lawyer and 'take' the kids before my lawyer gets back? I really want to hire the woman I've already spoken with. Would it be in my best interest to not wait? I'm in Michigan and am currently looking into the divorce laws. There is also quite a bit of verbal and emotional abuse issues that come into play when I'm talking about custody. Any thoughts on this? I just don't want him getting the upper hand when it's obvious that he'll only go for custody to hurt me. Thanks in advance Doll

Well if you have not hired her yet then how is she your lawyer? Have you signed an agreement or have you even met with her yet?
If your ex files, usually a temp hearing will be scheduled shortly after that to determine custody arangements and such.

perhaps stating that I hired her was wrong. We had that first conversation and I knew right away I wanted to use her. So...once she gets back, I'll have the money. She said she'd be able to help me. I just don't want him to gain custody, not fully anyway. I have pages and pages of his drinking and abuse which I was advised to document. I guess I'll just have to wait and see. Thank you for your reply.
