Taxs are not in DH's custody order so he is not sure how to handle this.
DH and his son's mom have shared custody. We found out that she has been allowing her stepdad to claim my stepson (C). He is also claiming her. We were told that DH can claim C if the BM chooses not to claim him.
We thought somehow the BM was claiming him because she claims to file her own taxs. The truth is her stepdad has claimed him for 2006 and 2007 without DH knowing until now. She lied and said she was claiming taxs from cash assistance she received. DH started second guessing it because she stopped receiving cash assistance when C was a few months old and DH started pays court ordered CS.
How can her stepdad legally claim C without my DHs permission? How can her stepdad claim her? What can DH do about this?
Her comment was that DH could turn her in for fraud because she went through it when her mom was busted for fraud and all she will have to do is pay back the money and DH will really be paying it through the CS since she don't work.
