Will consolidation allow case to go to Feds?
      #391037 - 04/17/08 01:25 PM

Hello Everyone. I am writing to you from NY for an NY case. Here are the facts:

Ex-husband owes in arrears as of today $114,000 total for judgments I received in 2004 for the following:
Present Child Support
Dependant Care
Judgment for past child support
Interest on the above
Judgment for past dependent care
Interest on the above
Judgment for medical expenses for children
Interest on the above.

My ex does not live in this state and I want it to become a federal case. I have been denied because the Fed.s will only take the case if the ex owes $100,000 or more in "Child Support" alone. Not the other expenses. This is ridiculous because it would take another 8 or more years for the total in "Child Support" to reach that amount. I was wondering if I was to get a consolidated judgment for the total amount owed if it would help me to make the case a federal one and then be able to have my ex extradited back to NY from Oklahoma. He is guilty of the Dead Beat Parents Act over and over again but I still can't get the case to the Federal level. I was just wondering if this would work?

Thanks for your comments.

I don't think there is any way to get a child support case in federal court...they don't have jurisdiction. But at any rate, the amount of damages for a case to be heard in federal court must be in excess of $75,000, not 100,000. Why not just let it be heard locally?

It's irrelevant in the eyes of the court. Child support has never been about what it costs to raise a child. You of all people know this to be true.

a) I believe she said "children". As in PLURAL children, not ONE child

b) She lives IN NEW YORK!

ONE year of costs for ONE child was $22K for me, again, NOT including ANY allocation for housing, heating, electricity, nor medical insurance COVERAGE.

Sooooo.. if she lives in the Long Island/Manhattan/Queens/Brooklyn/Bronx/Staten Island/Westchester County certain areas, it can EASILY cost $20K or more per year to raise A child. 5 years and you're at $100K. 10 years, you're at $200K. Add another child,well.. do the math.

Say.. childcare. If it costs you $1,300 for one? It costs you about $2,200 to $2,500 for two. That's NORMAL and CUSTOMARY. $1,300 for one? Is CHEAP.

I know it's hard to get through your head but it thoroughly pisses me off when people say to New Yorkers "oh,that's an outrageous amount, you couldn't POSSIBLY be doing YOUR fair share". Yeah, dumbass, they COULD. It's fvcking EXPENSIVE AS HELL to live her and raise children here. And no, wages are not even REMOTELY keeping up with cost of living.

Don't forget this includes Interest times 3 which adds up and Judgment for medical expenses for the children. Says children so I would assume it's more than 1 child. Depending on the ages and amount of children I can see where $114,000 could be half.
