 She left with our son and I don;t know where she is. I know they are still in town because I called my son's school. I want to see my son.
I am seeking counsel, but how will they locate her to ser the papers?

They will call relatives and try to get them to give out her address. If they still can't locate her, a notice can be placed in the local paper and that will serve as "serving her."

Then go see him. STBX...meaning you aren't divorced? Have you even been to court? Does she have custody? IIRC, this is fairly new, so the court hasn't ordered anything, right? Then go see him. In fact, you can even pick him up at school and take him home with you if you want. No one has custody per the courts yet, therefore, you're both permitted to pick your son up from school, even to go to the school and have lunch with him and visit with him. She can't prevent this absent a court order.

I don't want to cause any problems at school. We just moved here a couple of months ago; new to town and school. And, she is extremely emotional. I don;t want to get baited into a confrontation with her. She already has a restraining order against her from the property manager where lived. she cannot be within 200 feet of the property. That the type of irrational person I am dealing with. I have spoken to my son, but I am proceeding with filing, and am courious as to how they will locate her. I don;t know where she moved to.

If she's THAT emotional, to the point that an outside party had to get a restraining order against her, is she safe with your son? If you even THINK she may not be, I'd be picking him up at school and filing for emergency custody, and showing the evidence of her emotional instability in order to keep him safe.

I am a grandmother with Joint Custody of my Son's little boy. The mother keeps threatening to get custody of the baby and make it so my son will never see him again. I have secondary custody, my son has primary custody. The baby is only seven months old so if she decided to disappear he would have a hard time getting to see him again. My heart goes out to you. I am doing everything possible to keep that from happening to my son. We live in North Carolina and she lives in New Jersey. She has supervised visitation only. She did not show up in court so we were awarded custody. You need to file for custody of your child and fight like crazy to keep him!!! Until then you can file for physical custody until the court hearing. If it is going to put a scare in her and make her run, serve the papers with the Sheriff and take custody right then and there. Your lawyer should know what to do.
