grandparent rights with unmarried teens
      #44612 - 11/15/05 04:21 PM

We have a 17 year old son. He and his girlfriend, also 17, are expecting a baby in April. They plan to be married after they both graduate school in June. By then, they will also both be 18. The girl's mother hates my son and does all she can to try to break them up and is not supporting their marriage plans. We are concerned that between the time the baby is born and the kids get married that she will try to do something. Can she file for custody of the baby? Should we be doing anything ourselves?

Nobody is going to give a grandparent custody of a child with willing and able parents there. Don't worry. :) You should just be knittin' some booties. :)

I would make sure your son's name is on the birth certificate. I don't know for certain about your local laws....but a lot of fathers have a hard time getting decent parenting time because they have to jump through hoops to "prove paternity" to the court....even when the entire county knows who the baby belongs to. Also, if she prevents their marriage for any period of time, he will be responsible for child support....even if all three of them (mom, dad and baby) live in your house. I know...it's crazy....but that's how it works.

As for her getting custody.....no way. But....that's another bonus for getting his name on the birth certificate....just in case. He would be the "known father" and entitled to certain rights within the family court system.
