Finally divorced after two and a half very long years!! Trial went well...distribution equitable, etc. There is a tax issue. Judge ruled that we are both responsible for taxes and taxes should be filed married but separate. I've filed on time every year since I left, and have already filed married/separate. Ex says that he hasn't filed anything and there is huge community liability. Marital house is to be sold, and I suspect that ex is trying to get IRS to put lien on the house prior to selling. Anybody have any experience with this sort of thing? Any help/suggestions would be greatly appreciated.

You're divorced and you have to file married but separate??

OOPS! Sorry...my fifth grade English teacher would be very disappointed to see that I had turned out something so unclear....
My ex didn't file taxes during the pendency of the divorce. I moved out (and took the children) in May of 2003. I filed married but sep for 2002, 2003, and 2004. He says he hasn't filed for any of those years...hasn't filed any returns AT ALL!! Does anyone know how the IRS will treat me? He makes A LOT of money, so he must owe the IRS several hundred thou for those years. I feel certain that he is calling the IRS and telling them that if they want their back taxes, they better put a lien on the marital home that is about to be sold. Anyone have an idea of what they may do? Any suggestions for what I can do? Thanks

I was also separated for 2 1/2 years and filed married but separate in 2003 and 2004. Since the divorce was final Nov. 15, this year I will file on my own. While separated, I filed as Head of Household because as the custodial parent I have the children most of the time. I found out my ex also fraudulently filed as Head of Household to get the tax break. During the final divorce negotiations I asked my attorney if I could be held liable if he got caught and she researched it and told me no since we filed separate returns.
