Let's say there WAS a clause in an original order limiting move-aways to the immediate county or contiguous ones.
CP/NCP started out 20 minutes from each other. CP moves ANOTHER 25 miles further, in a contiguous county, making the drive for NCP to get child nearly an hour(w/traffic) instead of 20 minutes.
As a result, NCP can no longer keep child on Wednesday/Sunday nights & take the child to school the next mornings. Well, NCP COULD but it would involve getting up & being ready to LEAVE the house at 5:30 AM in order for NCP to NOT be late to work too.
So... could NCP still take Ex- back to court for moving & effectively restricting the CO'd visitation? Even though the move was within the parameters originally established?

Yes, you can file to modify due to a substantial change in circumstances.
This does not mean that you will win. It only means that you have a very valid and legitimate claim.
Please be aware that whenever you take someone back to court, you have a chance that the terms may not be to your advantage.

I'd say no although I would think the CP my have a shot at changing the CO a bit to receive the missed out time in other ways. Like more time when the kids are on school break or in the summer. That's iffy though because the CP isn't refusing anytime and the NCP "could" still have that time. They choose not to because of the driving schedule. Hopefully this is a situation where the parents could agree on mild changes that would benefit the child.
