If you were married in west virginia but you were a resident of virginia for 3 yrs do you have to wait 6 months to become a resident of west virginia again to be able to file for divorse.

i have a son in the military overseas now and they got married in west vir but they moved to virg for 3 yrs and have a son.Is she a resident of west vir now or she does have to wait 6 months to be a resident again.

What part of residency do you not understand - it means where you live and if WV has a 6 month period to be a residence, then it is a 6 month period. It doesn't matter if she lived there all of her life expect for 3 years - it matters where she lived for those 3 years before she moved back to WV.

So, she has to wait 6 months to be a resident of WV again.
