separation agreement
      #508405 - 02/27/09 01:30 PM

Hello,
I am in the process of writing my separation agreement. I am getting a dissolution because we both have agreed on everything. We don't have any children together and we don't have any property. My question is with debt can we both just agree to handle all debt in our own names? We never had any loans or anything financial together. She has numerous medical bills and I don't want to be responsible for those. We live in Pickaway county Ohio. Also how would that be written and would I have to find all the bills she owes and list them or is there a blanket statement I could make.

I'm sure it varies from state to state, but I used a blanket statement in mine. It said something to the effect that husband shall be responsible for all bills in his name only and wife shall be responsible for all bills in her name only. All bills in both names will be equally split. There were none that were in both names. I used the blanket statement because I knew he had bills that I didn't know about...

Yes. Courts will not second guess agreements of parties on debt and asset division.
