      #508682 - 02/28/09 05:44 PM

I been mentally and physically abused. married for 11 years. have 10 y.o. son. Moved out after I finished college. hubby bought 3 buildings during our marraige. I HAD MY OWN SCHOLARSHIP DURING COLLEGE AND A STIPEND TO COVER MY BOOKS AND TRANSPORTATION. HE MADE a little MORE THAN ME IN SALARY (only worked for a yr). I HAVE PRIMARY CUSTODY AND HE DID NOT PAY ANY SUPPORT WHILE I LEFT HIM (about a yr and a half). Is he entitled to my degree and licence? i live in NY state.. and am i entitled to property?

In New York, compensation for a degree is possible as part of property division. Generally, when a spouse works full time job and supports the other spouse while hs/she attends school and/or pays tuitiuon costs for that spouse, the spouse who provided that support may seek to share in the profits from the investment in the professional spouse's education and training. \

The leading case in new York is O'Brien v. O'Brien, 498 N.Y.S.2d 743 (Court of Appeals, 1985) which explains the reasoning why professional licenses are considered an asset which can be distributed.
