Tax refund

My girlfriend is in the process of divorce. When she filed her taxes she did so as head of household and filed seperatley. The divorce is basicaly done. It will be a no fault divorce and everything has been divided and decided on. The papers are done and she has signed them. There was no mention of her giving him any part of her refund in the divorce papers but now he is saying he should get half. Her return was larger than his because of the difference in income and the fact she qualified for the tax income credit. He makes about four times as much as what she makes and I don't think he should get it. Am I wrong?

In my opinion, if the divorce is final and she filed separately then whatever she gets is hers and whatever he gets is his. I don't know if my opinion holds any legal validity, but it's what seems right to me.

Her return. Her refund as long as she didn't claim him.

I claim my ex on a joint refund, signed her name, direct deposit the money in the bank and kept it 100%.

And if the IRS finds out you signed the EX name, that's tax fraud and criminal fraud. Look for jail time on both charges.

I signed her name on the E-file forms...IRS dont care about that! She would have to fight it out in court to get the money back, she lost last time, the judge found me credible that I used the money for household expenses...didnt care I forged her name!(he was a retired criminal law judge too).
