Trial and witness list

I just found out that my sons father has a witness list for the trial in a month for custody. He has my son to be ex husband which we are going through a nasty divorce, he has my soon to be ex foster care worker whom I have never met and she cant say anything about how I am as a person or how I am with my boys, and they have 2 ppl that they say I have hitmy boys. The only time I have ever "hit" my boys was maybe a tap on the hand when they were younger if that. They only reason they are trying to get me on hitting the boys is because their dad is in trouble for hitting them. Can they use these ppl even if I dont know them or going through a divorce with one.

I'm pretty sure they can have anybody they want. It's your(or your attorney's) job to discredit them, show their bias, or whatever.

Sometimes they have a witness list to scare you deal with the people they have on the list and figure out your defense. Most likely, they won't call these people.

The mother of SIL's kids did the same thing. The only one they called up was the step-grandma - after SIL's attorney was done with her, you couldn't tell if she was for BM or against her. She was not a creditable witness at all.

The answer to your question is YES. The other party has every right and responsibility to call anybody to the stand that they think can speak against you in court. Depending on how long you were married to your husband, he could be the perfect witness to attest to the type of mother you are, the way you run your home and things that you have or have not allowed (in regards to the boys) over the time you were together.
You have a trial in a little over a month and your own lawyer hasn't advised you to put a witness list together?? I would be be VERY concerned about that if I were you.
