Hi all My wife and I want to seperate after a 17 year marage we live in NY she is modrately disabled. and collects $400 ssi a month and has no other sorce of income. Two kids 17 & 15 we have agred that after the sale of our home all the proceds will go to her so I dont have to pay mantance. but will pay CS. the problem is the home is not ready for sale it will be a year before it is. the wife wants me to pay for her to live some ware else till I have the house ready for sale. and the kids can stay with me till then. it will cost me about $400 extra a week to help her leave. my child suport alone would be $300. she wants this in wrighting of couse but dose not want to file for speration till the house is sold. I dont if I trust her.
I is this a bad idea????

Sounds to me like you are paying maintance before you are ever divorced. Talk to a lawyer, you will need one anyway.

Don't commit to anything in writing without a lawyer's consultation. It will burn you later. They will come back later and say - He already agrees to this, and we want all of this as well.

Get all of the information together, and take the "free" consultation from an attorney. Almost all Family lawyers will give "1" free consultation to let you know the "worst case".
Then if you think that what she is asking is fair...work the whole deal out in one agreement.

I hope I read this wrong, but if you're keeping the kids with you I hope you haven't agreed to pay her CS. Get to an attorney asap.

no Im not going to pay cs but she wants me to pay her rent till the house is sold. then she says she will take the money from the house in sted of mantance and of couse she dose not want me to tlak to a lawer.. I alredy have they tell me not to do it but are so very vage on the mantiance issue. anyone can tell you how much cs you should pay but when you ask if you will have to suport your disabled wife they say well mabe. I cant make life changing moves on maybes. I'm just gald thaers a place like this Ive leared more here reading posts and other info then any lawyer ever told me..

Just remember that whatever you pay now will likely not factor in to what you have to pay later, unless you can get her to agree to it and have lawyers write it up.
