Need help ... NC laws
      #600267 - 11/16/09 04:07 PM

My soon to be ex-husband has agreed to give me full custody of our son in lieu of child support. We live in NC and I'm doing a DIY divorce. Is anyone versed in NC divorce laws? Do we need to do the financial forms?

Pretty stupid of him as child support can't be waived . Sorry , doubt your divorce will go through without addressing CS .

Careful. We don't want to learn from this.

He has no money anyway and it's useless to request something that our son will never get. He's over $45,000 in arrears with two adult children. And the courts haven't done a thing in the 9 years I've been with him. I see no reason for my son to suffer. And the ex will do what he has done in the past and just disappear. I can support my child on my own. And frankly, the ex can't support himself much less our son. You seemed to have posted quite a bit ... do you have any other suggestions?

You may be able to submit an agreement saying you would like to wave CS but a judge will not grant it. I would suggest submitting the divorce papers you've drawn up and see what happens from there. I see where you're coming from but it's out of your hands if a judge denies it. At least you'll get your divorce finalized and he can't blame you for not trying.

That isn't necessarily true - some judges will grant that, it depends on your state laws and where you live.

According to what I understand we can sign a waiver of sorts. It's simply a deviation of NC child support guidelines.
