I live in Maryland and have been married for 10 years this coming new years eve. I have been thinking about leaving for a few years and just now got up the courage to move on with it.
Here is how things are now.. 1: Been married for 10 years but been together for 15. 2: We have a 5 year old daugher that is in daycare and pre school. 3: I am the bread winner and my wife makes very little money. 4: The house is in both our names and has 2 mortgages on it. We owe more then its work right now because of the hosueing market. 5: we live pay check to pay check and have no savings. 6: one of the 2 cars is paid off. 7: My wife does not work and when she does it makes very little and cannot financially support herself.
I was thinking of getting a loan from a friend, and pay the mortgage, daycare, child support for a year. I just do not have the money to pay mortgage, daycare, child support, my apartment, alimony, truck payment, insurance and stuff all on my own..

Yes sorry..I just want to know if the plan i have to basiclly buy her out is good and should I go down that path?

I do not want leave her high and dry she can have the house, the car that is paid for, and just about everything..I just want my stuff and shared custody of my daughter..

First, child suport can always be modified. A court must also reatify any agreements on child suport which, generally, myust comply with the suport statutes in your state.
Second, you can certainly come to an agreement to pay a lump sum to equalize the division of assets and debt.
Third, custody issues are determined by a court based on what is in the best interests of the child. If you can reach an agreement on custody and parenting time, that would certainly be desirable.
