can i keep my husband out of the house?
      #609250 - 12/08/09 10:06 PM

my husband and i are divorcing after a year and a half. we have navy housing but he isnt staying in the house with me. hes threatening to throw out all my stuff if i dont clean the house out in time. our pre-inspection isnt till the 14th of december. and everytime he comes to the house he ends up yelling and cursing at me or getting in my face. am i allowed to keep him out of the house? or something. i dont want to be around him because he always gets so violent. he hasnt hit me or anything but he like points his hand in my face and everything. I don't know if i should call his boat or something but that seems like the only thing i could do.

I would get my things out of housing and let him deal with cleaning the house. Like yesterday. Problem solved.

if you are still there, all you need to do is contact the chaplen, your husband can not force you out. You can stay there up until the divorce is final. The chaplin will contact him and have a talk with him, if this does not help then you follow the chain of command.

Depends on who is the member, Chaplains have no Command authority, and I am not sure anyone can force a member to keep housing, unless there is a command policy in place that says housing will be filled prior to anyone living off post. If I was the member, I would choose not to go see the chaplain, even if suggested. A member is only required to provide the support required, through regulation or court order.

I really don't believe this is true. You can be asked to leave housing within 30 days for any reason.

On this subject I refer back to a situation several years ago where a (very stupid) sailor took his girlfriend in to get a military ID under his wife's name. His girlfriend then impersonated his wife at a divorce proceding to end the marriage. He then called his wife (who was living in housing) and informed her they were divorced and to get out. Housing gave her 30 days to vacate, because even though the decree was fake - the member had been gone for months, and it was clear she would be ineligible for housing shortly. And they can ask anyone to leave with 30 days notice (they generally just don't do that). I lived in privaized housing and I read the fine print. To my understanding that was still in there.

Before you start feeling sorry for the aforementioned wife - another couple in housing let her move in with them until she could find a place and THAT wife caught her screwing her husband on the couch in the middle of the night....ah the joys of military housing.
