NCO violation after ex wife's motion to modify
      #615197 - 12/28/09 11:43 PM

I'm Pro Se, Idaho state, and not finding what I need anywhere. Ex wife filed a motion to modify the divorce decree. I answered without filing a counterclaim. I denied everything in the motion though. The judges clerk said the judge will see there's a problem because of the denials and I can address the issues in court. NOW my ex wife has violated the No Contact Order and charges are pending, she hasn't been served with the summons yet. (forgive me but I thought a violation would be taken a bit more seriously by law enforcement??)
I'm wondering what I can do to postpone the modification and/or use the violation to my advantage in family court?
Sorry if I'm not clear with my explaintion, it was hard enough before, then throw in the NCO incident and it makes my head spin :) Thanks!

Who took out the no contact order? What is the modification for?

The no contact order will probably have nothing to do with the modification unless the modification is about dropping the no contact order.

The NCO is against my ex wife, she pled guilty to harassment charges and is currently on probation. After that whole fiasco, she filed to modify the divorce decree. I moved to be closer to my family, the stress was killing me. I suffered a stroke 3 years ago and I live in a manor for disabled people.
She continues to harass me, the last incident was in December when she called me to say my son had been beaten and in the ER (300+ miles away). It was all a lie. Stress like that make the nerve pain from the stroke 10 times worse.

I just want to see my boy and she won't even let me do that.

Thanks for any insight you may have.
