Mediation

My wife and I are planning to divorce, we are on good terms. We have a 17 year old daughter. We have talked about mediation, but should I consult with an attorney first? We live in California.

Most mediators are attorneys, so that's not necessary. But once you finalize an agreement together, it's best if you both hire separate attorneys to review the final draft before signing it.

It would be wise to consult with a lawyer and study the law on the issues. Going intoa mediation without understanding the law on each issue is a recipe for disaster. the mediator is not there to provide you legal advice.

Just so you don't dismiss Maury the attorney as padding his own bed, there are a multitude of legal issues that your mediator will not help you with, or be concerned about. If you both are in complete agreement, and you remain so into the future (very doubtful), nothing may come of these issues.

My mediator was not a lawyer and she was worthless. I really have no idea what she got paid for. She spent a total of 20 minutes on everything before hand. It was a waste of time.
