My son is 16. He lived with me until he was 13, then went to live with his dad. The first year was OK, but the last two things have declined.
His dad has been abusing him. There's been physical abuse, and lots of verbal and mental abuse. Things have gotten progressively worse over the past two years. He threw my son out of the house last week. I arranged for another family member to take him in. This family member says my son is welcome to stay until the end of the school year. I am in a different state.
A Protective Services case has been opened. The details are now coming out about how bad the abuse was. My son was hiding it because he wanted to stay in his school and didn't want to leave his dad.
Now, my son says he wants to stay with the family member until the end of the school year, then come and live with me. He doesn't want to go back to his father's. I see the logic of completing the school year, but I am worried that his father will try and get him to go back to his house, where the abuse is sure to continue.
What is the best way to handle this situation? Can I request Emergency Temporary Custody and still keep him in the school until the end of the year? Or, would I have to take him out of the school and bring him to live with me immediately? Am I likely to get Emergency Custody? Would it be better to just ask for a referee hearing? I've hear those can take four weeks. I'm not sure of the best way to protect my son in this situation. I'd sure appreciate some advice.
