Alabama SS 26yr marriage?
      #654887 - 04/23/10 01:33 PM

I would like an idea of what reasonable spousal support is for a 26yr marriage (amount and duration), considering she has not worked for the past 8 years.

1 child age 16. Homeschooled for the past 4 years. Will attend public school next year.
Wife has not worked in 8 years. Prior to that her income was about 25K gross
My income is 88k gross
I am 46, she is 45.

What she is asking for.

House will not be sold until child graduates, 3 years. Split profit.
I pay the house payment ($490), insurance ($750) and Taxes ($650), until the house is sold.
Spousal support, half of my salary for the next 3 years. With no provision for reduction if she is employed.
Child support and probably additional child care expenses.

Ruff estimate, I will have $1700 a month.
With child support, house payment and alimony, she will make $2900.

I am trying to stay uncontested but what she is asking for is hard to take.

You let the mother of your children STAY HOME AND NOT WORK. Very bad decision on your part and you will be puni$hed for it...
You know how you always hear in the media how stay at home mom's have it so rough ? Guess what ? You are the SAHM piggy bank. Buy some extra blank checks, you'll need them. Or arrange to meet her in Mexico for " reconciliation " its really your only other option. You thought a divorce would get her out of your life ? Yep, maybe, but not out of your wallet for a long time yet...Violence is really your best option. Do not stay uncontested, because at least after the court appearance you know it wasn't just HER sayin' you need to pay, and pay, and pay. It was the whole SYSTEM sayin' it...Marriage is for life buddy, divorce doesn't end your obligation by a long shot. It does end her obligation though.

I can guarantee one thing for sure, nothing will make you feel better than bringing her face to face to the violent consequences of her demands.

They may be legal, but fair ? Mmmmm, no...

Whoa, whoa, back up. You are doing this all wrong. you don't pay ALL of the bills AND alimony. You pay her alimony and with that, she pays the bills if she chooses to remain in the house.

What is a reasonable amount of alimony? My guess, @ you making $88k and her capable of making $25k, is her getting alimony in the $20k - $25k range for roughly 1/2 the length of the marriage.

Then you would pay CS on top of that...which should be pretty minimal since your incomes will be close to equal.

But only 3 years of alimony for a 26 YEAR marriage. Your dreaming. I'm thinking more like 10 to 13 years of alimony for a marriage of such long duration.

She's asking for way too much. Just buy your "ruff" estimate, I would fight every dime except CS and maybe some modest SS for 4 years, which would terminate upon employment, co-habitation or remarriage.

1/2 your salary is a ridiculous amount on top of CS added in, if that is what you meant. If it includes CS, I would pay that along with 1/2 the house, insurance and taxes, however..YOU control the sale of the home. I too had to keep paying the house payment while we at first had the house up for sale and she went on "lockdown" basically..not a single person was allowed in to look and this was 1995, when the housing market was rockin. My real Estate agent kept calling me to complain about it...over 25 calls...so, you need to control the sale of the home or she will milk you dry.."house to messy".."won't be home"...."open house too disrupting"...EVERYTHING...I ended up selling my share to her..which she never even paid me for..so in effect, she got the house free (and we owned the home outright)
