my ex-spouse is allowed to remain on my insurance policy under the Rhode Island Insurance Continuation Act. We have no kids. Does he have to pay the differnce in premiuems between a famlily and single plan? I only need a single plan.

I think this is a question for an attorney though the language in the Act is fairly straight forward. I happen to review it because MN was looking at a similar law. From my perspective/understanding, the Act only safeguards the spouses enrollment not any payments. In otherwords, the spouse cannot be denied the insurance simply based on the status of the divorce. The ex remains 'eligible' and cannot be denied on the basis of the divorce. The Act, from what I'm reading, does not require you to pay anything related to his participation. It just requires the insurance company to not deny the coverage based on your divorce.
Payment is a separate issue. The Act doesn't say you have to pay but you cannot remove him so... who's going to force him to pay? Again... this is an attorney question and you may need one in order to get out from under your ex simply requiring to remain on the policy but refusing to pay for his personal coverage.
It's never uncomplicated when it is associated with divorce is it.
