Ok, so stbx and I have been living apart for a year. He hired an attorney to start proceedings last week. We still maintain joint accounts and pay all bills together(the living apart started out for commuting purposes not breakdown of marriage)

Well its like the week after a mediator told him what child support was and he quits his job and got a new lower paying job 5 hours away.*and rented a house twice the price of his old apartment.
Well since we are in joint accounts still (he makes much more than I) I'm concerned about ME paying for his security deposit , rent, moving expenses. Is there anyway for me to get that money credited back to my settlement if I document anything he spends? I already helped him move out once (not knowing thats what it was) I'm not doing it again. In addition he is renting a house twice the size of ours, 3 x the land, and double the cost.The kids won't even live there much!

I'm also concerned about if I have to shoulder the cost of transporting the kids to meet him even though he chose to move away AFTER we decided to divorce. Shouldn't that be his problem? I really won't be able to afford the wear and tear on my already old car (He ran the miles up on) and I know the gas will kill my budget especislly now that he has lowered his income significantly.

Take half the money in the joint accounts and open your own.

Perfectly legal -- but then you'll have to start paying all the bills at the premises that you're located in.

There are other things that are involved in this situation but it appears that this is your question. It is customary for the parent that moved to pay transport for the children's parenting time with them. His getting a lower paying job may backfire on him as underemployment is usually against the law. His child support may be imputed at what his previous income level was.

How are you certain that his income has dropped? If he's renting a place that's twice the price, I'd tend to not believe that until I saw it in writing.

I am not sure of anything these days quite frankly. He just contacted me and said he wants our 17 year old to move with him. Well he is 17 and he can do what he wants but we made a joint decision earlier this summer to leave him be till after graduation. I think this is another ploy to lower his child support.
ANyway back to your question. He TOLD me it was for lesser money . He starts next Tuesday. I;m not sure if since he started this job so close to the proceedings if they will go with the average of the last 2 years? or present income. But he will have to report it officially right?
Our house payment is 500. His aprtment was 525. The new place is 800. I think he is trying to work the system to up his budget. Because the mediator we went to told him alot would be based on what we NEEDED. Hence the more expensive house. However thats MY spin. He switched jobs 2 days after he heard the child support and alimony amounts.

Um, no brainer, just don't deposit your check into the joint account. Take it and go open your own. Remove from the joint account what is a fair estimate of what is 'yours'.
