First hearing postponed. W/b 5 months from filing

Ok What do I do now? I've been waiting patiently since August for our first hearing on Wednesday to secure child support and possibly SS. Found out today they have postponed the "temporary" :emergency" hearing until LATE JANUARY!!!! How am I supposed to go that long with no help whatso ever? STBX released his paystubs and he has made in the last 2 months what it takes me 10 months to earn.Yet he can't send some money to help with his kids? This is ridiculous. I know at the hearing they will make him pay me back but it won't do me much good if I end up in the hole by then. Not to mention Christmas coming up with no savings whatsoever and the biggest ultility bills on the way.
I can't believe the courts are allowed to put off this first hearing like this.

I can't believe the courts are allowed to put off this first hearing like this.

LOL. The courts do things on "their" schedule. It could be that he (or his attorney) requested the postponment, or it could be that with the holidays coming up the court is just plain backed up. unfortunately judges don't much care about what the parties are going through when they schedule vacations.

I know it sucks but there is just nothing you can do about it. I've been there too. I've laid awake nights trying to figure out how i was going to find money for groceries to feed my kids. I still worry that things will go back to the way they were, and maybe they will but all we can do is live day by day and get through it.

Dont you only have one minor child in question?

My court case took TWO YEARS and I still don't even get child support.

Well I'm aware that the courts work at their own speed and I live in a small town with limited court resources anyway but...I would have hoped they would act on the first hearing and then drag their feet between the first and final hearing. I guess not. I have 2 minor children and one adult child living at home. One minor child lives with the father but I still pay some of his bills, I pay all of older sons (please lets not get into his responsibility of paying bills again). I am mamking it with my salary as of now. Hoping that I can do some type of Christmas with all 3 kids, as well as afford the high heating bills of the winter without any help from STBX. Last January our heating bill was $265. That is practically one month child support I can expect anyway. So while every little bit will help, and I am prepared to make the best of a difficult situation...it makes me wonder what someone would do that doesn't work if they have to wwait 5 months for an emergency hearing. Doesn't seem fair.

certainly sounds like the term emergency hearing is a bit of a misnomer

So your 20 year old son is going to let Mom go without food and heat so he can continue in college without working and helping out?

It also looks like the FATHER is going to let his kids go without. He!!, he doesn't even pay all of the expenses of the kid living with him.

Talk about a deadbeat.

To the OP: I hope the next hearing doesn't get canceled. You are asking that the support be garnished from his wages, right? Obviously, if your stbx is self-employed, this isn't an option. Then he will probably, based on his lack of supporting the kids to date, go on being a deadbeat.

Goodmom,
Yes, he is not shy about buying lots of things he doesn't need. Very shy about providing basics for his own children. Our hearing was canceled due to something medical with the judge. Which was probably unavoidable but you think they would put the canceled hearings ahead of the others rather than at the end of the line.
Luckily he is not self employed so if needed they can garnish his wages. At this time he shows up on occasion and buys them a pair of gloves,a necklace, video game, or takes them out to dinner. I guess he considers that child support.

So he is not clothing, feeding and housing the child living with him? And you know this HOW?

Nope, he has not missed a SINGLE payment.

Again, ONE kid lives with HIM< one kid lives with HER. So he is taking care of the one with him, she is taking care of the one with her.
