Can anyone give me advice on how to transfer child support jurisdiction from Florida to Colorado? The original order is in Florida, my ex who pays CS lives there but I live with our child in Colorado, where he was born. I read that I can if both parties agree, which he will not agree. Is there another way? The Florida court is biased towards him and I'm not getting a fair hearing.

It is my understanding that if one of the parents remains in the state that originally held jurisdiction, then it remains there. The logic is to prevent custodial parents from purposely moving to a state that has higher cs guidelines in an attempt to increase cs. I am not sure if this applies to all states though, so you may want to consider asking an attorney in your state. Most of them will give a free consult.

The FL atty said there may be a possibility but didn't give me any details. A CO atty answered that I'm covered under the uniform act but I don't want just enforcement under the act, I want to move the jurisdiction to CO. Does anyone have any experience moving jurisdiction from Florida? I will never get my exes consent to move it so that's not an option.

How much does the Florida court favor your ex if you were allowed, with the child, to Colorado ? In what way do you feel he is being favored.

I have always lived in Colorado, my child was born in Colorado. My ex was basically starving me out, forcing me to go to court in his home town and the only choice I had at the time was to concede that Florida has jurisdiction so I could get him to court to establish child support.

Did you start divorce proceedings in CO before he could reestablish residency in FL ?

We were never married. There was no court action in Colorado because I couldn't get him served so I agreed to jurisdiction in Florida so I could establish child support somewhere.

I don't think you will have luck without your ex agreeing to it because in essence you and your ex have already agreed to it, you were in CO and FL at the time of agreement so nothing has changed except you believe you aren't getting a fair shot. Can you tell me what's not working in your favor in FL?

How did your ex get to FL and establish residency to file proceedings if you're in CO and have always been in CO?

I know what she is after. The emancipation age in CO is 19. I live in CO. Many people try to move here when the kids got older so they can mooch another year. It's a mooching state.
