Visitation Before Court

Mediation has not worked ... my wife wants full control over our (2) year old daughter. As of today we have decided to retain lawyers. How long does a custody settlement usually last ... do I get to see my daughter while we wait to go to court? I am a NY State resident and a concerned dad. Lawyer appt. tomorrow.

Mine: moved out September '97, divorce/custody final Nov. '98. There should be a temporary hearing to establish temp. custody and child support (if any is granted) within 30 days however. These orders will continue until the final hearing at which point they may change.

Mine has been going on for about 6 months, still haven't had a temporary hearing or a court date. What we are doing right now is just verbal, don't agree to anything before a hearing that you don't want to do after a hearing. Good luck.

If your ex is not allowing you to see your child then your lawer should file an emergencty order for temporary child custody/visitation orders.

To have everything finalized, it took 2 years for me & my ex. But the temporary orders were done in two months.
