Hello everyone, So, I have my old court order, through Family court, that states the NCP and the CP shall share equally uninsured medical expenses and it also doesn't specify, how long the CP has to send an itemized statement to the NCP. I spoke to DCSS the other day and they told me it still stands. But, on the current 'Child Support' order it just states what the NCP is supposed to pay in CS only, nothing else. But attached to it is a form (FL-192) that says what the laws are... It states... "If you have a child support order that includes a provision for the reimbursement of a portion of the child's health-care cost and those cost are not paid by insurance, the law says: You must give a statement to the other parent within 30 days." But, I don't have a "Child Support Order that includes a provision for reimbursement", I have an order through Family court back in 2001, that specifies we should both be paying half of uninsured medical. I provide the health insurance for our daughter, because I have satisfactory insurance and she's been on it since shes been born. I only receive child support through DCSS. It doesn't state anything on the CS order about uninsured healthcare cost. It only states about the uninsured health care cost through our order through Family Court back in '01. So does the 30 day law still apply to me?! Or does the '01 order still apply. The uninsured medical on the '01 order, states both parents are to equally share cost of uninsured medical, dental, vision, orthodontics, and both parents should provide insurance... so confused! Your advice is greatly appreciated :)

Reasonably, you should submit the bills as soon as possible. What are you confused about? Is the other parent refusing to PAY< or do you have old bills you want to submit?

The thing is, My insurance changed a little in Jan 2011, so now I've been paying more out of pocket expenses. And, I was never aware NCP was supposed to pay half uninsured medical up until last week when I called and asked DCSS. I figured it would've had to specify on our CS order. I have one statement for May 2011, that I never sent to NCP and I have another one for this past March, that I plan on sending, I wanted to send both.. what do you think?

The March one, yep, no prob. The one from a year ago? Nope. You stated that you "just" found out that it changed, so why ONLY one from last May? Nope, I think you just eat that one and consider it a lesson learned.

My decree is a bit different. It works likes taxes, the CP saves all the bills all year then sends them to NCP by Feb 15th. The NCP has to pay 88% by Feb 28th.
Works pretty good, except this year I had 13 days to send her 3 grand.

What DCSS has said about the NCP paying 1/2 is not accurate. It must be court ordered and in your decree, UNLESS you are getting state aid.
With that said, it's not difficult to get it court ordered.
