I have CS court tomorrow! In the last 2 years, my ex has only sent 2 payments...one last July in the amt of $300 and the other 3 days ago in the amount of $69.23. He has a good job making great money since May...under the table of course. As far as I know, he still plans to claim he's been paying it all of this time by garnishment...and it's not his fault it's not been going to his account. I can't wait to see what happens when he tries to play that card.

---> If it's true, then it isn't his fault. He will need to provide copies of every pay stub where monies where withheld or a stub from last year and a current stub showing year-to-date totals of monies withheld. The court will then continue the matter while they investigate his employer.

I highly doubt it's being garnished. If it WERE? He wouldn't bother to send ANY additional payments. Just wait for his day in court and be vindicated. The fact he's sending anything independently would seem to signal he knows he owes.

He's lying. He is being paid under the table, so how can it be garnished? He told me he was filing a 1099 (so I won't get much if anything this year) as a self employed contractor. His whole story he told me...from CSE contacting his employer in June...is a lie. CSE didn't even know he was working until I called them in September...that's when they sent out the wage withholding order to them. I contacted CSE again in November for an update...because I had received nothing. They told me he was working under the table and there is nothing they can do about getting his employer to garnish.
He claims he has paystubs to prove it..but it is only a computer print out...and his wife is the office manager. They are both friends of the owner.

I sent him an email in July...telling him if he didn't start to pay CS (because I knew he had a good job)...then I would be hiring my own attorney to take him to court. The next day? There was a payment made to the account in the amount of $300.

---> Then instead of getting angry, simply give him the proper amount of rope in which to hang himself. I assume that since you have an attorney and said attorney is aware of the situation and that your ex intends to lie six ways to Sunday, that he has subpeoned ex's employers and/or their payroll records?
