My husband is military and currently stationed in El Paso TX. I have moved to Utah to be with my parents. I know I must be a resident for 3 months before I can even file for my divorce, but Utah also requires that BOTH parents have to take a custody class before the divorce papers will be accepted. My question is, can the class be completed online or is it strictly a go to type class, or because he's military and is unable to get here would the class be waived at least for him. I do not mind going at all. I just don't want my divorce to be held up by this technicality. Thank you to anyone who has the answers to this question and can tell me!

I don't know about Utah or Texas, but in NJ, both parents have to attend a court mandated "parenting" class before the divorce can proceed. The class was at the courthouse and you had to physically attend.

With your husband in the military he has the right under the SCRA to demand the divorce take place where he is stationed, currently a resident, or his HOR. So make sure he is consenting to this or is a aware of that. You'd hate to spend money only to have to start over again once he does find out.

My divorce was in PA I lived in NJ and did it with a home study guide took a test and was done. Did not have to go to PA

I will add that another state requires something similar, does not offer it online, and does not offer exceptions. My friend went to the class the night before his hearing because that was the only time he could fly in to make it. Each state is very, very different. Call and ask the people offering the class what the options are if you decide to take that route.

my divorce was in utah, and the class is offered via video for people who can't be there in person.
