Ex Won't sign, what are my options?

I was served papers 3 years ago, my ex is a nut job. I have agreed to everything, we had no property, nothing joint. The judge said no trial and ordered us to settle back in the fall. It is now March and she has told her lawyer she will not sign. What are my options, my lawyer seems to want to wait, but I want to get this done, what can I ask my lawyer to do? Can we approach the judge and let her know what has been going on? My ex doens't want me to have my life, now that she is losing control she wants to not sign....HELP!!! PLease!!!

Is this for a divorce or separation? When I approached my lawyer about this (in NY), he said that both spouses must sign for a separation, but not for a divorce. In fact, my ex signed nothing - did not even show up at the proceedings - and my divorce was granted with no wait or hassle.

I understand this is an old post, but it's something I'd like to expand on. My bf filed for divorce February 2006. His estranged wife (they've been living apart for 4.5 years, only thing that is CO is custody of the 2 children) refuses to reply to the petition. A few months after being served she asked my bf if he would consider a separation instead as she was going through cancer treatments and she had just gotten his insurance to okay it. He agreed so that she would have a year for her treatments. Well, she STILL hasn't replied to the petition and it's been over a year so they still aren't legally anything. She doesn't want the divorce for 2 reasons... 1) she wants his health insurance (she has 110% disability through the VA, but doesn't like to use them although she loves the $40,000+/yr tax free money) and 2) now that bf and I have a son together, she seems to think we'll be getting married and she can't handle the thought of that possibility... so she refuses to get a lawyer and claims she doesn't have the money for one. BF and her filed taxes together this year and they both got $5,000 back. BF has his saved for the day she does get things going, but she chose to buy the kids build a bears every week and take her bf to las vegas for 7 days.

Can he get a divorce by default? How long can she put this off? BF just wants to move on with his life. When she discovered I was pregnant (it was not planned) she suddenly was Mrs. BF. She yelled at him and told him he was disrespectful to her for getting another woman pregnant while still married to her. Phsaw! He's trying to NOT be married, but she won't sign.

Anyway, sorry for the lengthy post. :o)
