Hello. I am in Florida. My ex and I have equal physical custody. His girlfriend who he has living with him is a convicted felon, who, after violating felony probation (drug and intrerstate credit card fraud charges)2 times in 2 months by failing drug tests is now on community control. My son (almost 15) has found drugs in his father's bedroom and his father's drug dealer, who I can only guess was high at the time, called my house to speak to my ex and tell him "Those *blue things*" (xanax and lortabs) were ready for him to pick up. Other than calling dcf, is there ANY way I can keep this woman from my children? I was told by an attorney that just because someone has been convicted of a felony that is not grounds to keep them away from my children if their father sees fit to have her there, but now that she has been arrested 2 more times and placed on community control is it a different ballgame? I would appreciate any and all help. Thank you.

I would most definetly have your lawyer file a petition with the court ~ let the judge decide, not your lawyer. Most definetly call dcf and file a complaint. I dont know the laws in Florida, but when there was a situation here in Michigan with a friend of mine who had concerns about his child, he failed to contact dcf first and the judge frowned upon it. It was proven that the concerns he had for his kids were true and in the end it worked out for the best. If there are drugs in the house and if you feel or know your ex and or his g/f are dealing and are associated with drug dealers, do something now. I myself would not allow my child to go back to his fathers Its a risk of contempt id be willing to take given the circumstances
