custody not wanted

My wife left me and our 2 kids last year. My 7 year old has autism. Since she left I've had full responsiblity of the children's care with no help from her. She makes little effort to see the kids. I told her I want to move out of state, she says I can go but only with the 7 yr. old. I've told her I'm not seperating the kids and if she wants the kids she can have both of them. I doubt she'll take them in fact I hope she doesn't but my lawyer tells me if she refuses to take them and refuses to let me take them I can't leave the state. How is this possible? How have I become a prisoner of the state after I've already been victimized?
