The division of retired pay is left up to the states, and the judges discretion, generally the states use a formula, (a percentage x the number of years) but these can vary by state to state and some states refuse to consider the retirement as community property, but may consider it if there is any alimony. The best person to ask would be a lawyer in the state that this is happening. And retirement pay is considered his entitlement minus and disability, so maybe a number is better than a percentage, but again, ask the lawyer.
