The assumption from your first post about these evil servicemembers faking disability to take away money from an exspouse and the "you can beat them!" pep talk? As a former servicemember, I am quite sure Miranda found the characterization a little offensive. I don't know how else anyone would take that.

The fact is an exspouse takes a gamble when they take a portion of an exspouse's retirement. A gamble that s/he actually does retire. A gamble that s/he doesn't do anything in retirement that violates the UCMJ and causes the retirement to be lost. A gamble that he doesn't die early, also ending the benefit. And yes, I believe a genuinely disable person should not be held to the full retirement pay obligation to an exspouse. Disability is not something contemplated at the time of divorce and that person DOES need more money for care and upkeep. A person disabled at the time of divorce is entitled to greater financial care from an exspouse, such as alimony and greater amount of assets. Why a former spouse of a military member shouldn't be held to that same standard is beyond me.

I'll also add that my Aunt works for the VA in this area. It is outrageously difficult to be declared disabled. There is a stringent criteria; with no give. The idea that someone could "fake" it does not ring true to me, knowing what she deals with on a daily basis.
