It sounds like the as of yet mentioned court case decided that it will be left up to the judges. Not all veterans will recieve dual compensation immediately, so this unmentioned case may affect some more than others. I think one of the issues coming up will be the fact that certain former souses agreed to a specific amount of money, not a percentage. That number may never go up or down. Of course if a veteran is 50% disabled and then later found to be only 25% disabled, should the former spouse get more money from the disposable retirement pay, well of course she should, just as she should get less if he disposable pay goes down, she should get less, oh wait, thats not fair, its only fair if she gets more money no matter what. Its bad enough the way it is right now, now you have former spouses gettign more money regardless of the agreement they made, or had a lawyer draw up and they signed or they agreed to. Are we really concerned about being fair or just insuring that the former spouse gets more money and the veteran gets less.
