Well...this has been a frustrating thread. It's worse than pulling teeth, trying to get beenthere to cite this case of which she speaks.

I have a little snippet too:

Once the VA makes a decision about a newly retired member's disability rating (which can take 4+ months), DFAS must collect overpayments from the FS, when a disability determination causes the Former Member's disposable retired pay to decrease as a result of his/her election to receive disability in lieu of retired pay. But you have to ask for it.

One thing I noticed, BT doesn't talk about the unfairness when a FS is able to reap the benefits of all the promotions and pay raises which have occurred since the divorce. But unlike her, I don't have a crying towel.
And what of concurrent receipt??
Why not mention that in 6 or 7 years, when CR is fully implemented, there will be no loss of retired pay for the FS?
