the answer depends greatly on your state laws. If you are not married, the presumption will be that the person in whose name the property is titled has ownership. Some states allow a non-owning party to prove that some agreement or contract was made whereby the parties agreed to share in the fruits of their joint labors including homestead equity. Wisconsin is such a state. Even there, however, the burden is very high and falls on the person seeking the interest.

If you intend to cohabitate, negotiate a cohabitation agreement in advance.
