Hi there... I just logged on here today to ask a couple of questions and ran across yours. I just want to tell you what happened with my divorce in 1996. My ex was just retiring from the Air Force when we became divorced. We have two children. In the divorce decree, my children were not entitled to receive any child support from his military retirement pay. So he made sure that once he was retired that he didn't work another job! Thus, no child support. I am trying now to go back and get back child support since he came into a rather large inheritance last year.
Concerning what you're entitled to, since you have been married for 12 years of his military life, they will figure a percentage of that (his pension) that will be paid to you by direct allotment. Mine was supposed to be 3/10 since we were married for 13 years... so in other words, 3/10 of his retirement pay. However, he never signed the papers necessary for me to receive the money. I was in such emotional turmoil at the time of our divorce that I never even paid any attention to a lot of the things that I've recently discovered as I sat reading my divorce decree one day. I suspected some sexual abuse to one of my previous children and my main thing was to get him out of our lives. I am now filing a pro se' motion petitioning him for violations in several areas of my divorce decree. I just hope I can get some kind of restitution.
I am sorry to hear about your situation. Please do not make the same mistakes that I have made. GET YOUR MONEY THAT YOU ARE ENTITLED TO! Has he given you any of his military pay since he left you 4 weeks ago? If not, you should be seeing one of the lawyers on base. They usually have walk-in appointments between 8-9 am. M.W. & F. but call first. He is still responsible to you and to any children you have.
