What are my rights as an unemployed mother?

---> Unemployed mothers have no special rights.

Will my husband be required to help me financially until I find a job?

---> Yes, it's called "alimony".

Will I have an type of benefits such as medical insurance during and after the divorce?

---> Your spouse will be required to keep you on the current policy/program DURING the divorce, but NOT after it is final. The law does allow to continue with the same policy/program, but you will have to pay for it.

We do not own our home, we are renters. Will I be able to keep the apartment?

---> That is dependent upon the Judge AND your landlord. While the Judge can grant you exclusive possession of your current residence, he cannot force the landlord to continue to "rent" to you.

I could wait until I take the test and find a job, but that could be months or up to a year. I don't think I can wait that long. I am getting desperate here.

---> JUST because you can't afford to take the test, DOES NOT MEAN that you can't find a job to support yourself and to contribute to the support of your joint children UNTIL you can afford it.

I went to a lawyer about 2 years ago and he advised me that I have relatively no rights and no access for financial help from my husband once the divorce is filed and final.

---> He is correct to a certain extent. Outside of some temporary support and equitable distribution, you will have no rights or access to any additional financial assistance from your EX-husband.

Surely this is not true!

---> Why wouldn't it be? Would you expect an employer to continue giving you a paycheck if you are no longer working for them? Would you continue to pay a babysitter after they've gone home? So why would you expect your EX-husband to continue supporting you AFTER you divorce him?
