Yep, it is going to boil down to what your daughter wants. He can petition the courts for custody.

If your daughter wants to be with you, then fight it. If she wants to be with him and he is not ABSOLUTLY CPS level UNFIT... then you will save everyone a lot of time, money and grief by letting her go.
