For starters, she didn't need to file for custody which is probably why she did not. She is an unwed mother... she HAS custody... she does not need to file it.

Get your visitation via court order. But be prepared.... your chances of custody are one in a million. I don't care what he laws pretend... they don't take babies from Mom's without some SERIOUS stuff going on.

And I know you say you have proof of all you said but I don't see HOW? You need court admissable proof. Videos, pictures, etc. In the very least neutral unbiased witnesses of much more then "one" occassion of these things.

As for the court order, I can't say about your state. In PA and TX though any custody agreement that is not filed with the court means nothing. So because they were not married, the law gives her custody by default. If he wants visitation, he needs to get a court order. So she is not in contempt or anything at this point.
