As I said, as commendable as that is... it is also deceitful. The way to start out fatherhood is not via lies. If he wants so badly to give a fatherless child a father then he should look into adopting one that does not come prepackaged with a psycho ex to deal with, legal issues and court.

Also, think ahead...

On a long shot... the child needs some medical history that is vital... and Dad has to tell child he may not be dad. THE TRAUMA! He thinks it was traumatic not having a father? Believe me, it is traumatic have one that is a liar too. It is VERY traumatic thinking your entire life was a lie.

On a more likely front... say you and he have a child together... are you going to now facilitate the lie and lie to your own biological child and tell them this is their sibling when you don't even know if it is?

Not to bash... but your DH's reluctance tells me that not only is he well aware that there is a chance he is not the Dad and BELEIVES that... but that his character is potentially questionable. He is putting himself and you in the middle of a heated court battle that will lead to 18 years of dealing with this woman for no other reason then to soothe his consious over the loss of his father. That's not healthy Alisha and you should not enable it.
