You seem to be confused… This is from the Georgia Superior Court website:
“The spouse who has been served with a Complaint has 30 days to file a response. In the response (the Answer) the spouse may contest the reasons alleged for the divorce or contest the claims for child custody, child support, alimony, or property division. If, however, an Answer is not filed within 30 days, the right to contest the complaint may be lost.”
“In Georgia, the divorce petition must be filed in the court for a minimum of 30 days. If the parties can agree on all issues and the defendant has acknowledged service, the final divorce can usually be obtained shortly thereafter. If there is difficulty in getting the defendant served and/or if there are contested issues involved, it can be several years before the court can resolve all of the issues involved. The decree of divorce has full effect as soon as the judge signs it.”
31 days is only if this is an uncontested divorce…
If she is not in agreement this could take a long time…
You cannot realistically expect to be divorced in the next 2wks or even this year... Even if you have compiled your net worth, have copies of all your asset statements for the last two years, and created a preliminary agreement so you guys can at least see what you are left to argue about..... ya still have the "negotiation" part.. that takes a wee-bit of time...
If you look at PM's posts you will see that she has been preparing for her divorce for most of this year.. She can give you a very good idea of what to put in your suggested agreement... I think she said just the custody portion is 35pages... (she tends to be very through and a wee-bit anal but in a good way)...
You need to set some more realistic expectations…
Are you saying that you don’t know yet if this is a contested or uncontested divorce???
Have you presented your version of a stipulation of settlement?
Are you waiting for her to show you hers??
Your posting makes it sound like custody is being contested???
You never said that in your prior threads… That will be a whole new can of worms….
