In Georgia, where I was divorced, you can set a court date 30 days after you've filed for divorce.
For an uncontested divorce, that means that theoretically, you can be divorced in 30 days. However, even an uncontested divorce has a process that may take a few weeks, such as getting all the agreements signed, notarized, and delivered.
I filed for mine the beginning of November and my court date was New Year's Eve.
The thing that drags on ANY divorce is coming to agreement on property division, support, and custody. In the case of my ex, he and I had already split our property...he took his stuff when he moved out "to think things over". Custody was a non-issue even though we had two children because he wanted a lifestyle that was unencumbered, and support was the price he paid for that. Nothing onerous...just the fair amount plus a point or two to pay me back for the lawyer (he never got one of his own).
I'd say, if you want your divorce over with quickly, sign any agreement your spouse's lawyer sends to you. However, if you want a fair divorce, you have to learn the art of negotiation. And if you want to win it all, you have to learn to fight dirty.
The sticking point to all that is that your STBX and their lawyer can be on a "dirty" wavelength even if you are willing to play fair and negotiate. That will end up escalating the time and cost of the divorce. I think most divorce strategy is to fight fire with fire. So if they are playing fair, you can play fair. But if not, well, then you have to put on your big boy pants and see where their weaknesses are, and if you can exploit them to your advantage. It goes beyond negotiating to actually setting things up so that their weakness becomes their downfall.
