The court order doesn't say what to do with the tax return. Only, the refund should be split. I also made a mistake. He wants my 2005 tax return, not 2006. He claims that since we ran a business together, that he should be entitled to some of the business deductions. I can PROVE he abandoned the business in Feb. 2005, leaving me with 11 months of paying for and generating income for the business by myself.
I was mainly concerned that he wanted half the mortgage interest, which would actually hurt me if he took half because to keep the house running, I took a hardship withdrawal from my 401k. So, long story short, I need all of the deductions I claimed that year in order to owe as little as I owed. I'm STILL paying the IRS income tax for that year.
I can guesstimate that he made very little money that year, which would result in him owing the IRS around $100 after deducting mileage, so, any excess deductions would not be beneficial to his scenario anyways.
