Spousal support (alimony, maintenance etc.) and assets... you are wise in getting more of assets in lieu of alimony. I tried for that and EX not willing to agree so ended up having to go with what the magistrate decided. I would much rather have had the assets equal things out. For one thing.... I didn't want any connection to my EX other than our son, d-i-l, future grand kids and being at mutual events.

As to the business going to your stbx and spousal support issue.... I do not look at this as double dipping. I think they are two separate issues. The business as an asset is different issue from the earning capabilities of each of you. Your share of the business asset going to him in exchange for his share of the house going to you.. would offset each other. The assets are a separate issue from earning income or capabilities.

i receive spousal support. As stated I would rather have had the $$ in asset settlement. Ours is the standard remarriage or cohabitation clauses. I have no problem with that.

I was asked by my brother and s-i-l if my niece could stay with me while she attends a local community college that does not have dorms. They all live 3 hours north of here. Of course I said yes because I will do anything I can to help my family. It is unfortunate that none of them live close IMO.

My brother is insistant on paying me something each month. All I want is for her to purchase food she wants that I don't normally buy. I am in full expectation of my EX finding out my niece (and his for 16 if her 21 years of life) is staying here.. and his filing contempt of court order against me re the SS. Using cohabitation, and requesting doing financial discovery by claiming that she is, or may be, paying toward my living expenses. If he does it may well involve my niece and her parents being dragged into the courtroom. I hate the thought of that. I would much rather live my life with having received the same $$ amount in assets vs monthly. I have the unhappy chore of advising my brother and s-i-l of this possibility.
