Hi Miranda,
What I've been saying is that I intend to try to AVOID a big legal fight by proposing a very simple solution. He won't communicate w/ me, so we can't mediate or negotiate directly or just work things out like 2 adults. So I'm looking for a clean & complete break.
= I want sole ownership of the house b/c he won't pay bills (even ones in his name), make decisions about repairs, or talk about how to sell it. = I want him to keep his practice b/c it's his, & b/c I can't stop him if he chooses to let his business fall apart through his own irresponsible behavior. = I want us to split our other assets -- 50/50, 60/40, whatever. = I want him to pay our lawyers & other costs of divorce. = I want the gifts & heirlooms my own family gave me; he can have the cars, dining room set, stereo, etc., etc. Should be easy. I don't even need a lawyer for this, except to force Mr. HeadInTheSand to fill out the necessary documents.
Now I know I can't prevent him from fighting if he chooses to. But so far the problem is that he seems completely inert -- maybe he's paralysed by guilt? As you see from the tital of my post, I don't want to take advantage of him. I hope we get a deal that fair to us both.
l thought I WAS reading carefully -- most people on this board told me that what I'm planning to ask for is reasonable and won't create an incentive for stbx to fight. Did I miss something?
