Great news! The OP hearing went almost entirely in my favor. My wife made a huge mistake taking my daughter out of state (6 hr drive) without a court order. The judge is aware of it and he is NOT happy.

My mife agreed to a consent order stipulating only that I not be in the same physical premises with her, and that I cannot contact her verbally. I am allowed to contact her via email and regular mail. She pays all court and attorney fees. I drove home in one of my vehicles (remember I was stranded in the middle of nowhere without transportation.) She will continue paying all of our bills, and write me a $150 check every two weeks for food and gas. I can run a tab for doctors appts and prescription drugs, and they will be billed to her. I can stay here on the farm until it is sold (which will take a long, long time -- and it has no equity) or another agreement is made down the road. There was NO finding of abuse on my part.

I think that God sent me a very good attorney. I went in expecting the worse, and ended up with more than I wanted. Who cares about no physical contact? I wopuldn't want it anyway, because I'd always be worried that she concoct another abuse charge if we were in the same room. The communications aspect was real important to me, and you can't imagine how happy I am not to be stranded here anymore. The consent is for 6 months unless sooner dissolved, and is not renewable.

Her attorney still thinks I should go out and get a job, but mine said he talked with my long-time physician (who will be deposed), and the extensive documentation of my absolute inability to work is air tight. He said it will be crucial in this case. He also said that my doctor will testify that my STBX KNEW that I was completely disabled, since she was present at every single medical encounter I had. My attorney says that this, too, will look bad in the eyes of the judge if she testifies that I am fit for employment, when another testifies that I am not and that she knew I was not.

He says that I WILL end up with maintenance, probably for at least half the marriage (half of 25 is 12=1/2 years), and a long shot (but possible) for life. He couldn't predict how much, but noted that she makes in the top 10% of wage earners in the state, so it would be higher than normal.

This is a lot to digest, but I went from near hopelessness to a good position in a single hearing. He will file a motion to have my dau returned to Missouri, which will create hardship for my wife. It may take time, but once she realizes she faces financial ruin over this, she might be willing to consider something like an informal separation (not legal separation, since that involves property and custody settlement) which could give us time for therapy and , God willing, eventual reconciliation.

I was, however, saddened that both of my children would not talk to me, look me in the eye, or even acknowledge my presence. It is pretty obvious that my wife has them within her emotional control, and there is nothing I can do about it at the moment but pray for them
