My H and I are staioned here in Oklahoma. I'm not sure if you were told the correct information on where your Fiance will need to file. Because he is military and a resident of Texas. He can still file in Oklahoma... I dont know there seperation time prior to filing but if they have been seperated for over six months, all he has to do is tell the court at filing his date of physcially seperating from his wife. If there is no kids property no nothing then it will be pretty simple. In Lawton, OK if he is staion at Fort Sill courts are never crowded and easy to get in and out of. The wife doesnt have to be in OK to get the divorce done she can answer by mail. Now as far as filing the divorce in California, ther is no waiting or seperation period prior to filing. SHe the wife would need to file and order to show cause for divorce. and when she files, she will get a court date within 30 days to 6 weeks. SHe has to serve your fiance and show proof of service. Now in Calif once the divorce has been declare they have to wait 6 weeks & 1 day or 6 months and 1 day for the divorce to be finalize. Or he can do like my cousin did, say he doesnt know her address, then the courts made him place an add in her local paper for 90 days and after no respons the divorce was granted on the spot at the proof court hearing. Hope that help you, Base legal will give him some name of lawyers that offer discounts to soliders. That is what my spouse did, but dont go to Lawana John she is horrible when it comes to 2 state cases. we had to fire her and pick another attorney. Once the divorce is done he will have to report his status change to Admin., He can continue to live off post, but he will not be eligble for the BAH. Can choose to move into the barrack, but they are already crowded and if he is on tradoc side of Fort Sill, the barracks are full. only spaces for recruits. Beside cost of housing in Lawton not expensive. Rent is really cheap 1bdrm apt run 250.00 a month 3 brdm home 550.00-800.00 a month. Without the bah he can still make it. Just a question if your fiance is a resident of Texas he's stationed in Oklahoma he's on 30-45 minutes drive from Witchta Falls, Texas he can file, I only reference Fort Sill Lawton area because this is the only Army base in OK and you said live of POST, POST = Army.
